By accessing or using TestMyBill.com, creating an account, uploading a document, answering a questionnaire, generating a letter, or downloading any output, you agree to these Terms of Service in full. If you do not agree, do not use the Service.
1. What TestMyBill.com Is
TestMyBill.com is owned and operated by Westenders LLC, a North Carolina limited liability company doing business as TestMyBill ("TestMyBill," "we," "our," or "us"). TestMyBill provides a web-based software tool that uses artificial intelligence to help patients and their authorized representatives understand medical bills and generate template correspondence letters that may be used in communications with healthcare providers, insurers, and billing departments (the "Service"). TestMyBill does not submit letters or claims on your behalf unless we expressly state otherwise in writing.
2. Not Legal, Medical, Financial, or Insurance Advice
TestMyBill is not a law firm, medical provider, insurer, insurance producer, claims administrator, debt-relief provider, credit counselor, or financial advisor. No attorney-client relationship, healthcare relationship, insurance advisory relationship, fiduciary relationship, or financial advisory relationship is created by your use of the Service, regardless of what you share with us or what letters we generate for you.
Letters generated by the Service are template documents for informational and personal use only. They are not legal pleadings, formal legal notices, appeals filed by TestMyBill, insurance coverage determinations, medical necessity determinations, or professional correspondence. Results depend on many factors entirely outside our control, including the policies, discretion, and practices of your healthcare provider, insurer, billing department, collection agency, or other third party. We make no representation, warranty, or guarantee that any letter will achieve any particular outcome, reduce any bill, reverse any insurance denial, stop collection activity, satisfy a deadline, preserve a legal right, or produce any other result.
You are solely responsible for deciding whether, when, and how to use any information or letter generated by the Service. You should consult a licensed attorney, financial advisor, patient advocate, healthcare professional, insurance professional, or other qualified professional before taking legal, financial, medical, insurance, or time-sensitive action regarding a medical bill, insurance claim, denial, collection matter, or healthcare decision.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of another person, such as a minor dependent, family member, or patient, you represent and warrant that you are legally authorized to act on that person's behalf and to share that person's information with the Service.
4. Acceptable Use
You agree to use the Service only for lawful, personal, non-commercial purposes. You agree that you will:
- Upload only bills, explanation-of-benefits documents, insurance documents, collection notices, or other medical financial documents that belong to you or to a person for whom you are legally authorized to act
- Provide accurate, truthful, and complete information in questionnaires
- Not use the Service to generate fraudulent, misleading, or deceptive documents
- Not make false representations to healthcare providers, insurers, or any third party using letters generated by this Service
- Not access, scrape, reproduce, or redistribute the Service or its technology for commercial purposes
- Not attempt to circumvent, disable, or interfere with any security or access-control feature
- Not upload files containing malicious code, viruses, or harmful components
- Not use the Service in any way that violates any applicable federal, state, or local law or regulation
- Not use the Service for emergency, urgent, or time-sensitive medical, legal, insurance, financial, or collection matters
- Not use the Service to make, support, or automate a medical diagnosis, treatment decision, coverage decision, or other high-risk decision
We reserve the right to suspend or terminate access to the Service, with or without notice, for violations of this section or any other provision of these Terms, for suspected fraud or misuse, or where continued access may create legal, security, privacy, or operational risk.
5. Payment Terms and Refund Policy
The Service may charge a one-time fee to unlock and download a generated Action Packet. The current fee is displayed before purchase and may change from time to time. The paid product is a generated Action Packet that may include bill analysis, a personalized letter, a phone script, call-preparation materials, and related documents. Payment is processed by Stripe, Inc. or another third-party payment processor and is subject to that processor's terms of service and privacy policy. We do not control the payment processor's services and are not responsible for payment-processing errors outside our reasonable control.
All sales are final.
Because the core deliverable — the Action Packet, which may include a personalized letter, a phone script, a call checklist, follow-up email language, a bill review summary, and other downloadable materials — is a digital product created for you, with a preview of the letter shown prior to payment, we generally do not issue refunds. The Action Packet is the product; the fact that it may or may not achieve your desired billing outcome does not affect the completeness of our delivery, and we do not guarantee any particular dispute, negotiation, or billing outcome. Nothing in these Terms limits any non-waivable refund or consumer protection rights you may have under applicable law.
If you believe you experienced a documented technical failure that prevented generation or delivery of your Action Packet (for example, a confirmed system error that prevented display), contact us at hello@testmybill.com within 7 days of your purchase. Refunds, if granted, are at our sole discretion, subject to applicable law. If a refund is issued, you agree to immediately delete all copies of the Action Packet and its materials and not use or distribute them.
5a. Promotional Credits and Referral Program
TestMyBill may issue promotional credits (such as Future Action Credits and referral reward credits) and referral links. The following terms — stated in full in our Promotions Terms & Conditions, which are incorporated into these Terms — apply to all promotional credits and referral participation:
No cash value. Promotional credits have no cash or monetary value, cannot be redeemed for cash, are not refundable, and cannot be sold, bartered, or transferred except as expressly designed (for example, sharing your referral link).
One-time use and expiration. Unless stated otherwise, each credit is valid for a single future purchase, cannot be combined with any other credit or discount on the same purchase, and expires 12 months after issuance. Expired credits will not be reissued.
Referral rewards. A referral reward credit is issued only after a person who used your referral link completes a qualifying paid purchase. Self-referrals (using your own referral link, directly or indirectly, to discount your own purchase) are not permitted and do not generate rewards.
Fraud and abuse. We may decline to issue, revoke, or invalidate any credit or referral link — and may disable associated referral codes — where we reasonably believe there has been fraud, abuse, self-referral, automated or bulk redemption attempts, or violation of these Terms.
Program changes. We may modify, suspend, or discontinue any promotional credit or referral program at any time on a prospective basis. Credits already issued remain valid through their stated expiration unless revoked for fraud or abuse.
6. Intellectual Property
Subject to your compliance with these Terms, the Action Packet content generated specifically for you based on your bill and questionnaire responses — including any letter, phone script, call checklist, follow-up email language, bill review summary, and other downloadable materials — is provided for your personal, non-commercial use. To the extent TestMyBill has any rights in that generated content, TestMyBill grants you a limited, non-exclusive, non-transferable license to download, copy, and use it to communicate with your healthcare provider, insurer, billing department, collection agency, or other appropriate recipient about your own bill or the bill of a person for whom you are legally authorized to act.
The underlying software, AI prompts, workflows, interfaces, design, trademarks, service marks, trade names, data models, know-how, and technology of TestMyBill.com are proprietary and remain the exclusive property of TestMyBill and its licensors. You may not copy, reproduce, reverse-engineer, decompile, distribute, sell, rent, sublicense, or create derivative works from any part of the Service's technology or proprietary content, except to the extent such restriction is prohibited by applicable law.
You grant TestMyBill a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and use the information, files, questionnaire responses, and other content you submit solely as necessary to provide, secure, maintain, and troubleshoot the Service and, where permitted by the Privacy Policy and your privacy choices, improve the Service. You represent and warrant that you have all rights and permissions necessary to submit that content to the Service.
If you provide suggestions, comments, or feedback about the Service, you grant TestMyBill the right to use that feedback without restriction or compensation, provided TestMyBill does not identify you publicly as the source without your consent.
7. Disclaimer of Warranties
We do not warrant that: (a) the Service will be uninterrupted, timely, secure, available, or error-free; (b) any information extracted from your bill or other document by the AI system will be accurate, complete, current, or free of errors; (c) any Action Packet material — including any generated letter, phone script, call checklist, or follow-up email language — will be appropriate for your circumstances or achieve any particular result; (d) any third party will accept, respond to, or act on any letter or other Action Packet material; or (e) any defects will be corrected.
AI-generated content may contain inaccuracies, omissions, outdated information, hallucinations, or formatting errors. You are solely responsible for reviewing all extracted bill information, questionnaire responses, recipient information, factual statements, and generated Action Packet content for accuracy and completeness before using, sending, relying on, or sharing it. You should not use the Service as the only basis for any decision involving health, insurance, legal rights, credit, collections, payment, or financial obligations.
8. Limitation of Liability
TESTMYBILL'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO TESTMYBILL IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE DOLLARS ($25.00 USD).
Some jurisdictions do not permit the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. In such jurisdictions, the above disclaimers and limitations apply only to the fullest extent permitted by applicable law.
9. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TestMyBill and its owners, officers, employees, agents, contractors, service providers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of any provision of these Terms; (c) your violation of any rights of a third party; (d) any information you submit through the Service that is fraudulent, inaccurate, unlawful, or unauthorized; (e) any letter or other Action Packet material you send or share based on content generated by the Service; or (f) your use of the Service on behalf of another person without proper authority.
10. Health Information and AI Acknowledgment
By uploading a medical bill, explanation of benefits, insurance document, collection notice, or other health-related or billing-related document, you acknowledge and agree that: (a) TestMyBill is a direct-to-consumer software provider and, unless TestMyBill separately agrees in writing, is not acting as a HIPAA covered entity, business associate, healthcare provider, insurer, insurance producer, claims administrator, agent, legal representative, or advocate; (b) no physician-patient, provider-patient, therapist-patient, attorney-client, fiduciary, or similar professional relationship is created; (c) you are voluntarily sharing health-related, insurance-related, and financial information with a software tool; (d) you are solely responsible for any decision to send, edit, rely on, or share any letter or other Action Packet material generated by the Service, and for all consequences of doing so; and (e) your uploaded document, extracted data, and generated Action Packet content (including the letter and phone script) are automatically and permanently deleted within 24 hours after the Service generates your Action Packet, and you are responsible for saving your own copy before then.
The Service uses artificial intelligence solely to extract billing information from submitted documents and generate the available Action Packet content. The AI does not provide advice and does not operate as a general-purpose assistant. Separately, and only if you affirmatively opt in, the Service may retain de-identified or anonymized, non-identifying metadata about your bill, such as letter type and a coarse amount range, for aggregate research, analytics, and Service improvement, as described in the Privacy Policy. This retained metadata is not intended to identify you and is not subject to the 24-hour deletion schedule.
11. Privacy, Security, and Third-Party Services
Our collection, use, retention, and disclosure of information are described in the Privacy Policy and, for consumer health data, the Consumer Health Data Privacy Policy. If these Terms conflict with the Privacy Policy regarding the handling of personal information, the Privacy Policy governs to the extent of the conflict.
We use reasonable administrative, technical, and organizational safeguards designed to protect information submitted to the Service. However, no internet-based service, storage system, AI tool, or electronic transmission is completely secure, and we do not guarantee that unauthorized access, disclosure, loss, or misuse will never occur.
The Service may rely on third-party service providers, including payment processors, cloud hosting providers, analytics providers, email delivery providers, and AI infrastructure providers. These providers may process information on our behalf to help provide, secure, support, and improve the Service, as described in the Privacy Policy.
12. Governing Law and Dispute Resolution
Governing law. These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules, except to the extent federal law preempts or controls.
Informal resolution. Before filing any claim, you agree to contact us at hello@testmybill.com to attempt informal resolution. We will attempt to respond within 10 business days.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law, except as stated below. The arbitration shall be conducted on an individual basis before a single arbitrator. You and TestMyBill waive the right to a jury trial and the right to participate as a plaintiff, claimant, or class member in any class, collective, consolidated, private attorney general, or representative proceeding. The arbitrator may award relief only on an individual basis and only to the extent necessary to resolve the individual claim.
Arbitration opt-out. You may opt out of the arbitration agreement by emailing hello@testmybill.com within thirty (30) days after you first accept these Terms and stating that you wish to opt out of arbitration. Your opt-out notice must include your name and the email address associated with your use of the Service. Opting out of arbitration does not affect any other provision of these Terms.
Small claims exception. Either party may bring an individual claim in small claims court for disputes within the jurisdictional limit of that court, as an alternative to arbitration.
Injunctive relief. Notwithstanding the above, either party may seek emergency injunctive or equitable relief in any court of competent jurisdiction to prevent actual or threatened irreparable harm, misuse of intellectual property, unauthorized access, fraud, or security threats.
13. Changes to Terms
We reserve the right to modify these Terms at any time at our sole discretion. We will post the updated Terms on this page with a revised "Last updated" date. Changes are effective when posted unless the updated Terms state otherwise. Your continued use of the Service after any such change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.
14. General Provisions
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TestMyBill regarding the Service and supersede all prior agreements.
- Severability. If any provision of these Terms is found invalid or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions remain in full force and effect. If any portion of the arbitration or class-action waiver provisions is found unenforceable, the unenforceable portion will be severed to the maximum extent permitted by law.
- No waiver. Our failure to enforce any provision does not waive our right to do so in the future.
- Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. TestMyBill may assign these Terms in connection with a merger, acquisition, or sale of substantially all assets without restriction.
- Force majeure. TestMyBill is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, internet outages, third-party service failures, or government actions.
- Survival. Any provisions that by their nature should survive termination or expiration of these Terms will survive, including provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and general provisions.
